Dutch personal income tax return

People residing in the Netherlands are typically obliged to file an annual personal income tax return in the Netherlands.

Required?

In principle only if the Dutch tax authorities invite you to file a personal income tax return. Under certain circumstances you are obliged to request an invitation to file a personal income tax return.

When?

Annually;

1 May after end of calendar year (main rule);

1 September after end of calendar year (upon individual request);

1 May after end of 2nd calendar year (upon intermediary request);

Migration tax return

When moving to or from the Netherlands, you should file a specific migration tax return (so-called M-form)

30% ruling

The 30% ruling is designed to attract people outside of the Netherlands with specific or scarce skills.

What is it?

Tax facility to receive up to 30% of your salary as tax-free reimbursement;

Option to elect as partial non-resident for Dutch tax purposes;

Option to exchange your foreign driver's license for a Dutch one.

Conditions

Working under an employement agreement;

Having specific expertise not readily available in the Dutch labor market;

Recruited while living outside the Netherlands;

Having a valid decree issued by the Dutch tax authorities.

Setting up a limited liability company in the Netherlands

If you wish to set up a company in the Netherlands without risking your private assets and investments it is generally recommended to incorporate a limited liability company (BV)

General characteristics and requirements

Legal form: Besloten Vennootschap or "BV"

Timing setup: within 1-2 weeks, depending on notary

Incorporation: Dutch notary required

Registration: in the Dutch Chamber of Commerce

General compliance:

Liability: shareholders are in principle not jointly and severally liable

Setting up a sole proprietorship in the Netherlands

if you wish to set up a (small) business in the Netherlands which is not expected to incur significant risks and you wish to keep your costs low it is generally recommend to register a sole proprietorship (eenmanszaak)

Legal form: Eenmanszaak

Timing setup: directly at the date of appointment at the Chamber of Commerce

Incorporation: No Dutch notary required

Registration: in the Dutch Chamber of Commerce

General compliance:

Liability: owner is jointly and severally liable
